These terms are an agreement between you and LastWagon, a subsidiary of Hobo Express Cartage LLC, Tennessee ("LastWagon," "we," "us"), about your use of the LastWagon Android application, the LastWagon website, and the services behind them (together, the "Service").
Please read § 3 (Navigation and safety) and § 15–16 (Disclaimer and liability). They limit what LastWagon is responsible for, and they describe what remains yours.
1. Accepting these terms
You accept these terms by tapping to accept them when the app first launches, or by continuing to use the Service after we publish a revised version and ask you to accept it. If you do not accept them, do not use the Service.
We keep a record on your device of which revision of these terms, of the Privacy Policy, and of the Navigation & Safety Notice you accepted, and when. When any of those changes materially, we raise its revision and ask you again.
2. Who may use LastWagon
You may use the Service if you are at least 18 years old and able to form a binding contract. If you use LastWagon in the course of employment or for a motor carrier, you confirm you are authorised to accept these terms for that use.
3. Navigation and safety — the most important term here
The Navigation & Safety Notice is part of this agreement and is incorporated into it. You acknowledge it separately in the app because it matters more than the rest of this document.
In short, and without limiting it:
LastWagon is a driver-assistance and trip-planning tool. It does not guarantee that any route is legal, safe, or physically passable by your vehicle. You remain solely responsible for your vehicle, your load, your compliance, and your driving.
Where the Service hands a destination to an external maps application, that application is not truck routing and LastWagon does not control it.
4. Your licence to use LastWagon
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you control, and to use the Service, in accordance with these terms.
You may not: copy, modify, or create derivative works of the app; reverse engineer, decompile or disassemble it except where that right cannot be excluded by law; rent, lease, sublicense, sell or redistribute it; remove or obscure any proprietary notice, attribution or watermark; or extract the bundled truck-stop directory for use in another product.
5. Basic (free) functionality
Basic includes the pre-trip inspection tools, CDL study and practice material, the daily safety question, the Driver Ledger, the bundled national truck-stop and rest-area directory, the POI map, community parking, and Basic truck routing over openrouteservice.
Basic routing runs on a shared routing allowance that LastWagon pays for. It is finite, it is shared between every driver using the app, and it can be exhausted. We do not promise any particular number of routes, any particular allowance, or uninterrupted availability of Basic routing. When the shared allowance runs out for the day, Basic routing is unavailable until it resets.
You may instead supply your own openrouteservice API key (§ 8), which uses your own allowance rather than the shared one.
6. Premium functionality
Premium adds routing, maps and search powered by HERE. Premium requires an entitlement issued to a LastWagon account.
HERE's terms apply to you directly. Before Premium first uses HERE, we ask you to accept the HERE End User Terms and acknowledge HERE's privacy policy and supplier notices. If you decline, Premium features stay off and everything in Basic continues to work. See third-party/here.md.
Premium features depend on HERE's service. If HERE is unavailable, or if our arrangement with HERE changes or ends, Premium features may change or stop.
7. Subscriptions, billing and trials
There is no in-app purchase, subscription or billing in the Service today. Premium entitlements are currently issued directly by LastWagon.
When paid subscriptions are introduced:
- Prices, billing periods, renewal behaviour, trial length and conversion, and cancellation and refund rights will be stated at the point of purchase, before you are charged.
- Purchases made through Google Play are processed by Google and are also subject to Google's terms and Google's refund policy.
- These terms will be revised, their revision number raised, and your acceptance requested again before any charge is possible.
8. Credentials you supply
If you enter your own openrouteservice API key:
- The key is yours. Your use of it is governed by HeiGIT's terms, not ours, and any allowance, limit or suspension on it is between you and HeiGIT.
- We store it on your device only. We do not transmit it to our servers and do not log it.
- You are responsible for keeping it confidential and for all use made of it.
- We are not responsible for the availability, accuracy or cost of a service you reach with your own credential.
9. Third-party services and content
The Service depends on third parties, and it displays their content: openrouteservice and HeiGIT, OpenStreetMap contributors, OpenFreeMap and OpenMapTiles, HERE and HERE's own data suppliers, the U.S. Census Bureau, the U.S. Geological Survey, Vercel, Upstash, and Google. Their terms apply to their content and services. Attribution and the applicable notices are in Legal & Attribution in the app and at https://lastwagon.app/legal/attribution.
You may not remove, obscure, or interfere with any attribution, copyright notice, logo or watermark that the Service or a provider's software displays. Some of them are contractual conditions of our access to that provider's data.
10. Community reports — parking, ratings, weigh stations
The community features — parking reports, star ratings, and weigh-station status — have their own rules, in community-parking.md and community-reports.md, and those documents form part of this agreement. The essentials, common to all three:
- Report only what you actually observed, at the place you are reporting on; rate only a stop you have actually used.
- Do not submit a report or a rating you know to be false.
- Do not automate reporting, flood the service, script it, or attempt to manipulate what other drivers see — including a stop's rating.
- Do not attempt to distort the historical record.
- Do not attack, probe, or attempt to exceed the limits of the reporting or status APIs.
A community weigh-station status is never permission to act. The signage and the law at the roadside apply to you regardless of anything the app shows — community-reports.md § 1 says this at length, and it is the most important term in either document.
You keep ownership of what you submit. You grant LastWagon a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, aggregate, analyse and display your reports and ratings, and information derived from them, in order to operate and improve the Service — including retaining the historical record, detecting abuse, producing aggregated statistics, and developing predictive parking or station-status information. The licence survives your stopping using the Service, to the extent your reports remain in the historical record. We do not claim ownership of your reports and we do not need it.
11. Acceptable use
Do not: use the Service unlawfully or to help anyone else do so; interfere with, overload, or attempt to gain unauthorised access to the Service or its providers; circumvent rate limits, authentication, entitlement checks or usage restrictions; scrape, bulk-download or systematically extract the directory, the parking data, or any provider's content; use the Service to build a competing dataset; or use it in a way that breaches any third-party provider's terms.
We may rate-limit, suspend or block an installation or an account that does any of this.
12. Availability, changes, and beta status
LastWagon is beta software. It may contain defects, may change without notice, may be interrupted or discontinued, and may produce incorrect routing, incorrect directions, or incorrect information about a truck stop or a parking area. Features may be added, changed or removed.
We do not commit to any level of availability. Beta status does not reduce your responsibilities under § 3, and we do not treat it as licence to ship avoidable defects into a safety-relevant product.
13. Our intellectual property
The app, the website, the LastWagon name and marks, the interface, and the compiled LastWagon truck-stop and rest-area directory are the property of LastWagon, a subsidiary of Hobo Express Cartage LLC, or its licensors and are protected by intellectual-property law. Nothing in these terms transfers any of it to you.
Third-party content in the Service remains its owners'; see § 9.
14. Termination
You may stop using the Service at any time by uninstalling the app.
We may suspend or terminate your access, or an installation's access, if you breach these terms, if we must in order to comply with a provider's terms or with law, or if we discontinue the Service. Sections 10 (as to the licence in reports already submitted), 13, 15, 16, 17 and 19 survive termination.
15. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that the Service, any route, any map, any truck-stop record, any parking status, or any third-party content will be accurate, complete, current, legal for your vehicle, uninterrupted, or error-free.
Some jurisdictions do not allow the exclusion of certain warranties; those exclusions may not apply to you.
16. Limitation of liability
To the fullest extent permitted by law, LastWagon and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, business interruption, cargo loss, fines, penalties, citations, out-of-route miles, detention, or towing or recovery costs, arising out of or relating to the Service, however caused and on any theory of liability.
Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid LastWagon in the twelve months before the event giving rise to the claim, and (b) US$100.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
17. Indemnification
You will indemnify and hold harmless LastWagon and its owners, employees and suppliers from claims, damages, losses and reasonable legal costs arising from your misuse of the Service, your breach of these terms, your submission of false or unlawful content, or your violation of law or of a third party's rights.
18. Changes to these terms
We may revise these terms. When a revision is material, we raise its revision number and ask you to accept it before you continue using the app. The current text is always at https://lastwagon.app/legal/terms, and the revision you accepted is shown in Legal & Attribution.
19. Governing law and disputes
These terms, and any dispute arising out of or relating to them or to the Service, are governed by the laws of Tennessee, without regard to its conflict-of-laws rules.
You and LastWagon agree that any such dispute will be brought exclusively in the courts located in Tennessee, and each of us consents to the personal jurisdiction of those courts.
These terms contain no arbitration requirement and no class-action waiver. A dispute goes to a court. Nothing here prevents you from bringing or joining a class or representative action, or from bringing an individual claim in a small-claims court that has jurisdiction over it.
20. General
These terms, with the Navigation & Safety Notice, the Privacy Policy and the Community Parking Terms, are the entire agreement between us about the Service. If a provision is held unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign these terms; we may assign them to a successor to the business.
